Jack Wingate ethics complaint 2 MN DNR

 Commissioner Merriam,

 I would like to file a second ethics complaint against Fisheries Research Manager Mr. Jack Wingate.

 Reason 1.

 On October 7 2003 I asked Mr. Wingate if he supported Mr. Goemans decision to deny the import/stocking permit for orangespotted sunfish in 2001 on the basis that my farm was within the 25-year flood plain.  I provided Mr. Wingate a link to the 1996 DNR document that said my farm was nowhere near the 100-year flood plain.  I also provided Mr. Wingate links to documents showing that my facility was licensed for orangespotted sunfish since 1996.  I also provide Mr. Wingate a link to a July 12 2001 DNR document from the Director of Fisheries Mr. Ron Payer admitting that ponds on my facility were licensed for orangespotted sunfish.

 Despite this information Mr. Wingate stated that he continues to support Mr. Goemans arbitrary and capricious decision to deny the permit.  Mr. Wingate’s response was worded exactly the same as Mr. Hirsch’s response.

 Reason 2.

 I asked Mr. Wingate if he supported Mr. Goemans decision to deny the licensing of a new pond for all Minnesota species because of the threat of a 24+” rainfall.

I provided information showing that the pond would seep whenever it came within 24” of the top of the dike and the state record rainfall of 10.8”

Mr. Wingate stated that he supports Mr. Goemans arbitrary and capricious decision despite the information I provided.  I see no reason for the public to trust the judgment of these professionals when it is clear they are willing to support the violation of state law in order to protect each other.  The lack of trust in the DNR created by the actions of these individuals put our resources at risk.
