Every employee, who has documents that fall under a request, is asked to respond to the request. They are required to provide, for inspection or copy, all requested government documents classified as public, regardless of the use or who is making the request. 2. We do not monitor each employee who is gathering data. Our employees are aware of the requirements of the Minnesota Government Data Practice Act and we make every effort possible to meet our obligations under this law. Hope this helps answer your questions. Sheila Gebhard Department of Natural Resources Voice: (651) 296-6038 Email: sheila.gebhard@state.mn.us Fax: (651) 296-0902
>>> John <fishes@brainerd.net> 08/12/02 09:02PM >>> August 12, 2002 Ms. Gebhard, I do have some questions on the mechanics of DPA requests. 1. Who does the actual gathering of information? 2. If the employee that has written the emails is allowed to search for the emails does anyone monitor them to insure that nothing is destroyed? Thank you for your time. Sincerely, John Reynolds Midwest Fish and Crayfish Sheila Gebhard wrote: > Mr. Reynolds, > I just wanted to touch base with you and let you know that we are in the process of gathering the information you requested under the Minnesota Government Data Practices Act. >I know that your request was for copies of the data, but I wanted to make sure you know that under the law, you have a legal right to come in (at an appointed time) and inspect data without any charge. If at that time you want us to make copies, we can then charge for search and retrieval time, plus cost of copies. If you want to make your own copies (portable copier or scanner) there is no charge. >The reason I mention this is that with the number of staff you have requested information from, or as possibly having information, plus the hourly salary that they make, the cost to you could be considerable. > It's entirely your call. We'll move forward with providing copies as you requested, unless I hear differently from you. >At this time, I don't have an estimated cost for you. Several of the staff who you mention as possibly having data are currently on vacation. > I'll let you know when we have all the data collected. If you have any questions, please let me know. > Thanks. >Sheila Gebhard >Data Practices Compliance Official |
